Please read these Terms of Use (incl. Privacy Policy) for the Website carefully. By accessing the website [www.credittrust.ch] (hereinafter "Website") of CRIF AG, Certifaction AG and Intrum AG (all 3 hereinafter referred to as "CreditTrust"), you declare that you have read and understood the following legal information in connection with the use of the Website and that you agree to the Terms of Use.

Addressees of the website

The website is aimed exclusively at natural persons with full capacity to act who are resident in Switzerland.

Data privacy

The use of personal data is regulated in the privacy policy. The privacy policy is an integral and binding part of these GTC.

No offer

The information published on the website constitutes neither an invitation to make an offer nor an offer or a recommendation to buy or sell a product, to carry out certain transactions or to engage in any other legal transaction.

Website rights

All rights (including copyright, trademark and patent rights as well as other intangible rights) to all information and content (including texts, data, graphics, sounds and logos) on the website are, unless otherwise specified, the sole property of CreditTrust or the respective rights holder. Use of this information and content is only permitted for purely private, non-commercial browsing purposes. Any other or further use requires the prior express written consent of CreditTrust.

Warranty

CreditTrust provides its services carefully and professionally within the scope of its operational resources and the foreseeable requirements, unless CreditTrust is prevented from doing so by circumstances for which it is not responsible.

The buyer is aware that CreditTrust provides its services via the Internet or by utilising communication networks. In particular, due to technical faults, operational disruptions as well as disruption or interruption of communication networks and due to a failure of IT infrastructures or other parts of the infrastructure utilised for the provision of services, there may be temporary impairments or interruptions in the provision of services by CreditTrust. CreditTrust therefore gives no guarantee for the uninterrupted availability and faultlessness of its services.

Exclusion of liability

CreditTrust endeavours to ensure that the information on the website is accurate and constantly updated. CreditTrust provides the information without warranty of any kind. CreditTrust assumes no responsibility, credit risk or guarantee for the accuracy, timeliness, completeness, reliability or availability of the website or the information or results or certificate resulting from the use of the website or the service, nor that the website does not contain viruses or errors.

Liability claims against CreditTrust for damages of a material or immaterial nature are excluded to the extent permitted by law.

All offers are non-binding. CreditTrust expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without prior notice or to cease publication temporarily or permanently.

Links

The CreditTrust website contains links to third-party websites. When you activate these links, you leave the CreditTrust website. CreditTrust has no control over the websites of third parties, nor has it checked the websites of third parties linked to the website. CreditTrust is not responsible for how these third-party websites handle your personal data. The establishment of links to third-party websites is at your own risk.

Delivery of the certificate

The certificate will be sent automatically to the e-mail address specified in the order process after successful payment. The buyer is responsible for entering the correct e-mail address.
The buyer can also download the certificate manually for 72 hours after the certificate has been created. The certificate and all personal data will then be deleted.

Benefit and risk are transferred to the buyer at the time of successful payment by CreditTrust. The buyer is responsible for the receipt and safekeeping of the certificate. If the buyer cancels or misplaces the certificate, it cannot be redelivered.

The buyer recognises that it is his own responsibility and risk to have all the necessary technical equipment to receive the certificate.

Any modification or imitation of the certificate is expressly prohibited and will be recognised as a forgery during verification.

Prices

The price shown or communicated for the certificate includes VAT.

Payment

When ordering a certificate, payment is made either by charging the credit card (MasterCard, Visa) or Twint specified during the order process. It is at the discretion of CreditTrust to decide which payment methods are authorised.

Return policy

There is no general right to return a defect-free and correctly delivered certificate or a right to a refund. Should a refund nevertheless be made, this will be made automatically to the buyer by means of a credit to the means of payment specified in the order process.

Revocation or cancellation

Cancellation or withdrawal from the contract by the buyer is excluded, as CreditTrust has already provided services upon confirmation by the buyer. The contract or service comes into force upon confirmation by the buyer. After confirmation, the buyer must: a) provide CreditTrust with all necessary data completely and correctly and b) transfer the costs in full to CreditTrust.

CreditTrust reserves the right to withdraw from the concluded contract at any time without giving reasons (in particular, however, in the event of incomplete or incorrect information from the buyer or in the event of contradictory, expired or incorrect information from the legitimisation document).

Only in the event of unjustified cancellation by CreditTrust or unilateral changes to the contract by CreditTrust will payments already made be refunded to the buyer.

These terms of use can be amended at any time

CreditTrust reserves the right to amend these terms of use at any time. The last line of these Terms of Use reflects the date of the last update.

Jurisdiction and applicable law

For all disputes arising from or in connection with the use of the website, Zurich is agreed as the exclusive place of jurisdiction, unless otherwise provided by law. CreditTrust unilaterally reserves the right to bring the dispute before any other competent court that would normally have jurisdiction over you. These Terms of Use are governed exclusively by Swiss law.
